These Terms of Use ("Terms") govern your access to and use of the website and services provided by CapexMD, LLC ("CapexMD," "we," "us," or "our"). By accessing or using our website or services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the website or use our services.
Loan Products and Services: CapexMD offers uncollateralized personal loans for fertility-related services and medications. These loans are originated solely by CapexMD, LLC and are subject to the following conditions:
Loan Terms and Interest Rates: Loan terms and interest rates are personalized and may vary based on an applicant's income, credit history and creditworthiness; market conditions; and other factors. Any rates or terms provided on our website or by our loan specialists prior to a finalized loan offer are for informational purposes and are not guaranteed.
Eligible Expenses: Loans are exclusively available for fertility-related medical services and medications from providers that we partner with, listed on our website. This list is subject to change. We can facilitate loans that cover expenses from multiple providers, including pharmacies, and we will work with the individual providers to assess the total costs.
Eligibility: You may apply for a loan individually or on behalf of someone else. Meeting the basic eligibility requirements does not guarantee loan approval. Loans are restricted to U.S. residents.
Co-Borrowers: You may apply for a loan with a co-borrower, except for married couples who must apply jointly. Of the two of you, we will use the higher income and credit score to determine eligibility. Your co-borrower is jointly responsible for repayment of the loan.
Loan Approval: Loan approval, along with the final loan amount, terms, and interest rate, depend on an assessment of each borrower's credit history, creditworthiness, income, and debt-to-income ratio.
Application Process
Information Collection: During the application process, we collect personal information such as name, address, date of birth, social security number, driver's license number, income details, and employment history to verify identity and assess eligibility.
Document Submission: Applicants may be required to provide supporting documentation, including but not limited to, a copy of their driver's license, tax returns, and recent pay stubs.
Credit Inquiry: We will conduct a hard credit inquiry with one or more credit bureaus, which may have a temporary impact on the applicant's credit score.
Processing Time: We aim to process applications promptly. However, delays may occur due to factors such as document submission, information verification, or communication with healthcare providers.
Disclosures & Agreements: Complete loan terms and disclosures will be provided with your loan documents. Finalization of your loan is contingent on your acceptance of these terms and disclosures.
Fees and Payments
Application Fee: A $25 application fee may apply depending on the provider. This fee is payable by credit card upon application submission and is refundable if the application is declined.
Processing Fee: Approved loans are subject to a processing fee, which is deducted from the applicant's U.S. bank account via ACH. Routing & account information for this bank account must be supplied during the application process.
Repayment: Loan repayments are made in monthly installments via automatic debits from the same bank account via ACH.
Late Payments: Late or dishonored payments may result in late fees and/or loan termination. We may engage a collection agency if necessary.
Pre-payment: There is no penalty for pre-payment. You have the option to make additional payments or pay off the loan balance in full at any time, which will reduce the overall interest paid.
Electronic Communications: Applicants must consent to receive electronic communications from us regarding their application, including status updates, disclosures, account information, repayment information, and any other legally required information.

Limitations of Liability: CapexMD is not liable for any damages arising from your use of our website or services, including but not limited to, direct, indirect, incidental, consequential, or punitive damages.
Indemnification: You agree to indemnify and hold CapexMD harmless from any claims, losses, or damages, including attorney fees, arising out of your use of our website or services, or your violation of these Terms.
Governing Law: These Terms are governed by the laws of the State of Arizona. To the extent permitted by applicable law, any legal action arising out of these Terms shall be filed in the state or federal courts located in Phoenix, Arizona.
Severability: If a court of competent jurisdiction holds that any provision of these Terms of Use is unenforceable for any reason, you and we agree that such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law, and the remaining provisions of these Terms of Use shall remain in full force and effect.
Changes to Terms: We may update these Terms from time to time. We will post the updated Terms on our website and revise the "Last Updated" date. Your continued use of our website or services after the changes become effective constitutes your acceptance of the revised Terms.
